When a New Jersey will is probated, the executor or administrator has to
tell the people affected. Court Rule 4:80-6 gives you two deadlines:
- 60 days from the date of probate to mail a Notice of Probate to every
beneficiary under the will and to the decedent’s spouse, heirs, next of
kin, and anyone else entitled to letters; and
- 10 days from that mailing to file a Proof of Mailing with the
Surrogate.
This walkthrough writes both papers for you and works out both dates.
These are not official county forms and they do not pretend to be. The
Rule says what a Notice of Probate must say; it does not give any wording,
so there is no official form. Everything circulating under this name is a
county’s own house style. These are drafted from the Rule itself, with no
county name, seal, form number, or Surrogate’s name in them.
The Proof of Mailing uses the certification allowed by R. 1:4-4(b), so
you do not need a notary — you sign it yourself.
