This page covers the form titled “Information Subpoena,” identified in the footer of every page as “Revised 09/01/2024, CN 11840.” The caption places it in the Superior Court of New Jersey, Law Division, Special Civil Part, with blanks for the county, the docket number, and the plaintiff and defendant names. An upper-left block provides lines for a name, address and telephone number under the heading “Attorney(s) for.” The document is designated “Civil Action” and “Information Subpoena,” and is addressed from “THE STATE OF NEW JERSEY, to:” a named person or entity. Page one also carries “Print Form” and “Clear Form” controls.
Above the caption is a notice reading “IMPORTANT NOTICE - Please Read Carefully / Failure to Comply with this Information Subpoena May Result in Your Arrest and Mandatory Appearance Before a Judge of the Superior Court in Accordance with Rule 6:7-2(g).” The body recites that judgment has been entered in the Special Civil Part in a stated county, on a stated date, in a stated amount plus costs, with a portion remaining due and unpaid together with interest from a stated date. The form then states that court rules require the person subpoenaed to answer the attached questions within 14 days of receiving it, and describes a contempt hearing the opposing party may ask the court to conduct if the answers are not returned in time. It also recites that a default judgment may be open to a motion to vacate, refers the recipient to an attorney or the clerk of the court for information on such a motion, and says the questions must be answered even if the judgment is disputed. A further paragraph says that information about the income and assets of other members of the household need not be provided absent a financial interest in them. The page is dated and signed by the Clerk, with a line for the attorney.
Twelve pages long, the document then attaches two question sets. “Questions for Individuals,” numbered 1 through 17, asks for name, address, birth date, Social Security number, driver’s license number, telephone, employer and weekly gross and net salary, wage executions, bank accounts, income from alimony, loans, rent, pensions, interest, dividends and other sources, benefits the form describes as “exempt from levy,” residence and other real estate, personal property over $1,000, motor vehicles, business interests, and other judgments. “Questions for Business Entity,” numbered 1 through 19, asks about trade names, locations, stockholders, officers and directors, partners or members, other business interests of the principals, bank accounts, books and records, physical assets and liens, real estate, vehicles, accounts receivable, asset transfers within six months, cessation of business, other judgments, pending litigation, and the name, address and position of the person answering. Each set ends with a certification that the statements are true and a signature and date line. A note on the last page traces the form’s history from “Former Appendix XI-K,” adopted in 1990 and redesignated as Appendix XI-L in 1994, through amendments effective in 2004, 2014 and 2024.
