The Subpoena Ad Testificandum is a New Jersey court form numbered CN 11008, whose footer reads “Revised 09/23/2013, CN 11008.” It is a single-page document captioned for the “Superior Court of New Jersey,” with blanks for the Division, the Part, the County, and the Docket Number, a Plaintiff and Defendant caption separated by “v.,” and the designation “Civil Action.”
The top of the form is headed “Plaintiff or Filing Attorney Information” and collects the Name, NJ Attorney ID Number, Address, Email Address and Telephone Number of the plaintiff or filing attorney. The body of the subpoena is addressed to a named person and begins “STATE OF NEW JERSEY TO:”. Its command reads: “YOU ARE HEREBY COMMANDED to appear in person before the Superior Court of New Jersey, ___ Division, ___ County, ___ Part, at the ___ Court House located at ___ on ___ at ___ a.m./ p.m. and there to testify as a witness in the above-captioned matter.” The Division, County and Part blanks therefore appear twice on the page, once in the caption block and again inside the command sentence, alongside blanks for the court house, its location, the date and the time. The time of day is selected with a pair of checkboxes, one marked a.m. and one marked p.m. The form then states: “Failure to appear or comply with the command of this Subpoena will subject you to the penalties provided by law.”
The subpoena is dated on a line marked “Dated” and is issued over the printed name “Michelle M. Smith, Clerk of the Superior Court.”
The lower portion of the page is a “Proof of Service” section, completed by the person who served the subpoena rather than by the witness. Its text reads: “I, , being over the age of 18, served the attached subpoena by delivering a copy to ___ at ___ and by handing them the fee of $2.00 for one day’s attendance and, if applicable, a mileage fee of $, as allowed by law.” The $2.00 attendance figure is printed on the form; the mileage amount is left blank, described only as “allowed by law.” The blanks in that sentence record the name of the person serving, the person served, and the place. The proof of service closes with the certification “I certify that the foregoing statements made by me are true. I am aware that if any of the foregoing statements made by me are willfully false, I am subject to punishment,” followed by a Date line and a Signature line. It is a certification rather than an oath: the page carries no notary or jurat block.
