This is a 13-page packet published by the New Jersey Judiciary Civil Division, titled “How to File a Motion to Dismiss the Complaint or to Strike the Answer for Failure to Answer Interrogatories” and marked “Special Civil Part.” Its footer reads “Kit Revised: 02/2026, CN: 10915.” A note on the first page states that the materials “have been prepared by the New Jersey Administrative Office of the Courts for use by self-represented litigants,” and the page adds that completed forms are to be submitted to the special civil part of the Superior Court in the county where the case is filed.
The kit contains three fillable forms and a set of instructions. Form A is the Notice of Motion, Form B is the Certification in Support of a Motion, and Form C is the Order. All three carry the same caption: “Superior Court of New Jersey, Law Division, Special Civil Part,” with fields for County, Docket Number, and the names, addresses, email addresses, and telephone numbers of the Plaintiff and the Defendant. Form A offers checkboxes reading “Strike Answer for Failure to Answer Interrogatories” and “Dismiss Complaint for Failure to Answer Interrogatories”; Forms B and C carry the same pair with the second worded “Dismiss for Failure to Answer Interrogatories,” under the heading “Certification in Support of Motion to” on Form B and within Form C’s opening recital about the matter “being opened to the court.” Form A also carries oral-argument checkboxes reading “I do not request Oral Argument” and “I request Oral Argument.” Forms A and B are signed above a line reading “Check one: Plaintiff / Defendant”; Form A carries that signature block twice, once on the Notice of Motion and again on the Certification of Service.
The last page of Form A is that Certification of Service, with checkboxes for personal service or “By mailing it to the person(s) or attorney(s) listed below by regular and certified mail,” and blocks for four names, certified mail numbers, and addresses. Form B states that the certifying party either “made an unsuccessful attempt to confer with the other party to get the answers to my interrogatories” or “sent the other party a letter (copy attached)” warning that continued failure to answer would result in a motion to dismiss the complaint or suppress the answer. Below a line reading “Do not write below this line, for court use only,” Form C leaves the ORDERED text open for the judge and then prints a vacatur paragraph, a service paragraph, and “This motion was: Opposed / Unopposed,” above a signature line for a “Judge of the Superior Court.” The vacatur paragraph refers to a restoration fee “of $25.00 if the motion to vacate is made within 30 days after entry of this order and in the amount of $75.00 if the motion is made thereafter.”
The instruction pages walk through eight numbered steps, state that “The fee for filing a motion is $25,” and include a page headed “Things to think about before you represent yourself in Court,” which points to county legal services programs and county bar association Lawyer Referral Services and lists what court staff can and cannot do - among other things, that staff cannot give legal advice, cannot recommend a lawyer, and cannot talk to the judge on a litigant’s behalf. The packet closes with a glossary defining terms such as Answer, Complaint, Default, Docket Number, Motion, Order, Return Date, and Service.
