“How to Ask the Court to Change/Enforce an Order in Your Case or Request Another Related Action in Your Case (Family Multipurpose Post-Judgment Motions)” is a 36-page packet prepared, per its own note, “by the New Jersey Administrative Office of the Courts for use by self-represented litigants,” and marked “Revised 08/06/2020, CN 10483.” Forms A, B and C are captioned for the Superior Court of New Jersey, Chancery Division-Family Part, with spaces for county and docket number.
Under the heading “Who Should Use This Packet?” the packet states: “You can use this packet if you have an order from the court that you wish to change or enforce in your divorce, your civil union or your domestic partnership.” It further states that “Family court motions are governed by Court Rule 5:5-4,” that “unless otherwise noted, this packet is for use in cases with an ‘FM’ docket number,” and that a motion for reconsideration “can be used for cases with the letters ‘FM’, ‘FD’, and ‘FV’.”
It lists the motion types it covers, among them motions to increase or decrease child support, to terminate or continue child support, to increase, decrease or terminate alimony or spousal support, to change custody, to change visitation or parenting time, to enforce litigants’ rights, for emancipation of a child, for reimbursement of medical expenses, for change of venue, for removal (relocation) of children, for reconsideration, to resume a maiden name, to reinstate a divorce complaint, and cross-motions.
Eight lettered forms are included: Form A Notice of Motion, Form B Certification in Support of a Motion, Form C Proposed Order, Form D Certification of Filing and Service, Form E Notice to Litigants, Form F Statement for the ____ County Probation Division (“The following information is submitted in compliance with New Jersey Court Rule 5:7-4”), Form G Letter to the Clerk of the Superior Court, addressed to the “Superior Court Clerk, Family Part,” and Form H Acknowledgment of Personal Service, which carries a Notary Public block. Form D recites that the original Notice of Motion, the original supporting Certification, and the original and two copies of the Proposed Order are filed “with the Clerk of the Superior Court at the ___ Family Division Manager’s Office.”
The packet cross-references other forms by CN number, including the Confidential Litigant Information Sheet (CN 10486), the Case Information Statement (CN 10482), the Uniform Summary Support Order (CN 10284), and CN 10837 for appeals. It also cites the Child Support Termination law, “N.J.S.A. 2A:17-56.67 et seq.”
