The Information Subpoena and Written Questions to Non-Parties is a New Jersey court form numbered CN 10191-English, identified on the document as Appendix XI-R. The form is addressed to a non-party rather than to a party. It opens “THE STATE OF NEW JERSEY, TO:” and recites that “Judgment has been entered against” a named defendant “whose last known address is” a stated address, “in the Superior Court of New Jersey, Law Division, Special Civil Part,” in a named county. The upper left of the page carries a Name, Address and Telephone No. block, and beside the caption there is a field labeled “Social Security Number (If known).” The signature block at the foot of the first page provides a “Dated:” line ending in “20__,” an “Attorney for” line, and a line ending in the word “Clerk.”

The form states that “Attached to this Information Subpoena is a list of questions that the Court Rules of New Jersey require you to answer within 14 days from the date you receive this subpoena,” and that answers are to be given in section A, B, or C. It adds that if the questions go unanswered in time, “the judgment creditor or judgment creditor’s attorney may ask the Court to conduct a hearing in order to determine if you should be held in contempt,” and that the recipient will then be compelled to appear and explain the failure to answer. The document further asks for complete answers, allows additional pages to be attached, warns that false or misleading answers may be punished by the court, and directs that signed and dated answers be returned to the address in the upper left hand corner within 14 days. It closes with the notice that “SINCE THIS IS AN OFFICIAL FORM OF THE COURTS OF THE STATE OF NEW JERSEY, YOU CANNOT REFUSE TO ANSWER ANY OF THE QUESTIONS ON THE GROUNDS THAT THE INFORMATION IS PRIVILEGED.”

The attached questions are grouped by recipient type. Section A is “TO BE ANSWERED BY BANKING INSTITUTIONS” and asks whether the named defendant has any checking, savings or other accounts at the bank and, if so, the type, number and current balance of each. Section B is “TO BE ANSWERED BY EMPLOYERS” and asks whether the named defendant works for the business at present, the gross and net weekly salary including any overtime, and, if the named defendant is no longer employed there, the name and address of the current employer if known. Section C is “TO BE ANSWERED BY THOSE CONDUCTING BUSINESS WITH THE NAMED DEFENDANT” and covers past, present and future purchases of goods or services from the named defendant, and money the business owes. Each section closes with the certification “I hereby certify that the foregoing statements made by me are true. I am aware that if any of the foregoing statements made by me are willfully false, I am subject to punishment,” a DATED line, a Signature line, and a line reading “Print your name and title.”
